Terms of Service

To access and use BuyFyn, you must meet the following eligibility criteria:

• You must be at least 18 years of age or older.
• You must be a duly registered business entity, proprietorship, partnership, company, or an individual acting in a business capacity.
• You must provide accurate, current, and complete information during the registration process and keep your account information updated at all times.
• You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.
• BuyFyn reserves the right to refuse registration or cancel accounts at its sole discretion.

BuyFyn grants you a limited, non-exclusive, non-transferable, and revocable licence to access and use the platform solely for your legitimate business purposes, subject to these Terms.

• You agree to use the platform only for lawful purposes and in a manner that does not infringe the rights of others.
• You shall not use the platform to conduct any fraudulent, misleading, or deceptive activity.
• You are solely responsible for all content, data, and communications you post or transmit through the platform.
• BuyFyn reserves the right to modify, suspend, or discontinue any part of the platform at any time with or without notice.

Sellers agree to:

• Provide accurate, complete, and up-to-date product information, pricing, and availability.
• Honour all quotations issued and orders confirmed through the platform.
• Comply with all applicable laws regarding product quality, labelling, taxation (GST), and export/import regulations.
• Respond to buyer inquiries and quotation requests in a timely manner.
• Not list counterfeit, prohibited, or infringing products on the platform.

Buyers agree to:

• Provide accurate business and delivery information when placing inquiries or orders.
• Honour confirmed orders and make payments as agreed with the seller.
• Use inquiries and quotations in good faith and not for the purpose of extracting pricing information without genuine intent to purchase.
• Comply with applicable laws related to procurement, import/export, and payment of taxes.

BuyFyn acts solely as an intermediary marketplace connecting buyers and sellers. We do not manufacture, store, or sell products directly.

• All product listings are created and managed by registered sellers. BuyFyn does not verify or guarantee the accuracy of product descriptions, images, specifications, or pricing.
• Sellers are solely responsible for the legality, quality, and compliance of products listed on the platform.
• BuyFyn reserves the right to remove any listing that violates these Terms or applicable law, without prior notice.
• Products involving prohibited items, hazardous materials, counterfeit goods, or items regulated by law may not be listed on the platform.

The platform facilitates business communication through a structured inquiry-quotation-order flow.

• Inquiries sent by buyers are expressions of interest and do not constitute binding contracts.
• Quotations issued by sellers are offers subject to the terms specified therein, including pricing, delivery timelines, and minimum order quantities.
• A binding contract is formed between the buyer and seller only upon acceptance of a quotation and confirmation of an order by both parties.
• BuyFyn is not a party to any contract formed between buyers and sellers and holds no liability for the fulfilment, quality, or dispute arising from such transactions.
• Any disputes arising out of orders must be resolved directly between the buyer and seller. BuyFyn may provide a mediation channel but is not obligated to resolve disputes.

BuyFyn is a lead generation and marketplace platform. Payment terms are negotiated and agreed upon directly between buyers and sellers outside or within the platform as applicable.

• BuyFyn does not process payments on behalf of sellers or hold funds on behalf of any party, unless a specific payment gateway feature is explicitly offered.
• All taxes, duties, and levies applicable to transactions (including GST) are the sole responsibility of the respective buyer and seller.
• BuyFyn is not responsible for payment failures, fraud, or disputes arising from transactions between buyers and sellers.
• Subscription fees or platform charges, if applicable for premium features, are non-refundable unless stated otherwise at the time of purchase.

All content on the BuyFyn platform — including logos, branding, software, text, graphics, and design elements — is the exclusive intellectual property of BuyFyn or its licensors.

• You may not copy, reproduce, distribute, or create derivative works from any content on the platform without prior written permission from BuyFyn.
• By uploading content (product images, descriptions, etc.) to the platform, you grant BuyFyn a non-exclusive, royalty-free licence to use, display, and promote such content for platform-related purposes.
• You represent and warrant that you own or have the necessary rights to all content you upload, and that such content does not infringe any third-party intellectual property rights.

The following activities are strictly prohibited on BuyFyn:

• Creating fake accounts, impersonating another person or business, or providing false information.
• Posting spam, unsolicited messages, or misleading content.
• Attempting to hack, reverse-engineer, or disrupt the platform or its infrastructure.
• Scraping, crawling, or using automated tools to extract data from the platform without written consent.
• Listing or transacting in prohibited, counterfeit, illegal, or infringing goods.
• Using the platform to facilitate money laundering, tax evasion, or other illegal financial activities.
• Engaging in predatory pricing, bid manipulation, or any unfair trade practice.

The BuyFyn platform is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied.

• BuyFyn does not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.
• BuyFyn makes no representations or warranties regarding the accuracy, reliability, or completeness of any product listings, seller information, or user-generated content.
• BuyFyn does not guarantee the fulfilment, quality, safety, or legality of any products or services offered by sellers on the platform.

To the fullest extent permitted by applicable law, BuyFyn shall not be liable for:

• Any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform.
• Any loss of profits, business, data, or goodwill, even if BuyFyn has been advised of the possibility of such damages.
• The conduct, products, or services of any third-party seller or buyer on the platform.
• Any unauthorized access to or alteration of your account or data.

In no event shall BuyFyn's total liability to you exceed the amount paid by you (if any) to BuyFyn in the six (6) months preceding the event giving rise to the claim.

BuyFyn reserves the right to suspend or terminate your account and access to the platform at any time, with or without notice, for reasons including but not limited to:

• Violation of these Terms of Service or our Privacy Policy.
• Fraudulent, illegal, or harmful activity on the platform.
• Prolonged inactivity or failure to maintain accurate account information.
• Requests by law enforcement or government authorities.

You may also request deletion of your account by contacting us at customercare@buyfyn.in. Upon termination, your right to use the platform ceases immediately. Certain data may be retained as required by applicable law.

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

• Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation between the parties.
• If the dispute cannot be resolved amicably within 30 days, it shall be subject to the exclusive jurisdiction of the courts located in India.
• BuyFyn's failure to enforce any provision of these Terms shall not be deemed a waiver of its right to enforce such provisions in the future.

BuyFyn reserves the right to modify or update these Terms of Service at any time. We will notify registered users of material changes via email or a prominent notice on the platform.

Your continued use of the platform after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
